The Handshake (Acceptance)

By creating an account, accessing, or using the Afterword platform ("The Service"), you acknowledge that you have read, understood, and explicitly agree to be bound by these Terms of Service and our Privacy Policy. Together, these documents constitute the entire agreement between you and Afterword.

This is a binding agreement for a premium digital legacy service. If you do not agree with any part of these Terms, you are prohibited from using the Service.

1. The Service Provider

The Service is operated by Afterword, a digital legacy platform based in Basel-Landschaft, Switzerland ("The Platform," "We," "Us").

2. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement. We do not knowingly collect or solicit information from anyone under 18.

3. The Service: Your Sovereign Swiss Vault

Afterword provides a Zero-Knowledge digital storage and delivery system.

Role: We act as a secure, automated vault, not a custodian. Due to our encryption protocols, we do not have access to your legacy media content (voice notes, videos, and file attachments).

Legal Standing: We are not a law firm, estate planner, or financial advisor. Our service is a technical solution for data survival.

Function: Our sole function is to store encrypted data and release it only when your "Silence" is confirmed through our proprietary protocol.

4. Data Sovereignty & Server Architecture

We utilize a Dual-Region Infrastructure to balance global accessibility with ironclad privacy.

Identity & Authentication (Global): We utilize Supabase (global infrastructure) to manage login credentials, 2FA, and session security. This ensures you can access your account from anywhere in the world. Account metadata (email, name, recipient details, keyholder info) is protected by transport-layer encryption and access controls, but is not encrypted at the application level.

The Sovereign Content (Switzerland): All "Legacy" content—including text messages, voice notes, videos, and attachments—is stored exclusively on sovereign Swiss hardware via Exoscale and encrypted using AES-256 at rest under our zero-knowledge model.

Legal Jurisdiction: While logins are managed globally, your actual legacy data is protected by Swiss Federal Law, the global gold standard for privacy. Your content never leaves the Swiss Confederation until the moment of release.

5. Lifetime Membership & Payment Terms

One-Time Fee: Your payment of USD 149 (or the current listed rate at the time of purchase) secures a Lifetime Membership. There are no recurring subscription fees, hidden charges, or future upsells.

Payment Processing: All payments are processed securely by Stripe, Inc., a PCI DSS Level 1 certified payment processor. Afterword does not store your credit card or payment instrument details on our servers.

What You Receive: Upon successful payment, you receive: (a) a personal, encrypted Swiss vault; (b) unlimited message storage; (c) unlimited recipient designations; (d) the Pulse Check monitoring system; (e) the Keyholder verification protocol; and (f) automated message delivery upon confirmed absence.

Refund Policy (All Sales Final): Because Afterword immediately provisions dedicated Swiss-based infrastructure and encrypted storage upon your purchase, all sales are final. No refunds are provided once the transaction is complete.

Right of Deletion: You maintain the right to permanently delete your profile and all associated data at any time. However, the deletion of a profile does not entitle the user to a refund of the membership fee.

Irreversibility: Under Swiss privacy standards, once you choose to "Wipe Vault" or delete your account, the action is absolute. Your data is purged from our Swiss servers and cannot be recovered.

6. The Silence Protocol

The User's Pulse: The "Silence" trigger relies on your interaction with our system notifications. It is your sole responsibility to maintain a valid email address and ensure our notifications are not blocked by filters.

The Mandate of Silence: If you fail to respond to our notifications for the duration of your chosen "Silence Period," you explicitly authorize Afterword to initiate the Keyholder Verification Protocol. Your silence is recognized as your final command to execute the release of your legacy.

7. Keyholders & Dual-Verification Protocol

Zero-Access Guardianship: A Keyholder is a witness to your absence, not a viewer of your data. They are notified only if you go silent and have zero access to your messages at any time.

The Verification Workflow: Release of data is strictly controlled. To authorize a transfer, the Keyholder must:

  • Respond to an automated SMS/Email alert.
  • Successfully complete Multi-Factor Authentication (MFA) via their verified email.
  • Confirm your absence in good faith.

8. Security, Encryption & Account Recovery

Zero-Knowledge Model: Your legacy media content (voice notes, videos, and file attachments) is sealed using 256-bit AES encryption the moment it enters the Swiss vault. We do not store your primary access passwords in plain text.

The Master Recovery Code (Failsafe): Upon account creation, you are issued a unique Recovery Code. This code enables account restoration and access to your vault. It is your absolute and sole responsibility to keep this code secure, hidden, and stored offline. If you lose your credentials and your Recovery Code, your vault may become permanently inaccessible.

Integrity: Media files are stored with associated MD5 checksums to ensure that the data released to your recipients is exactly as you left it, free from corruption or tampering.

9. Third-Party Service Providers

In order to deliver the Service, we engage the following third-party providers. For full details, please refer to our Privacy Policy.

  • Supabase — Authentication & database infrastructure
  • Exoscale — Swiss sovereign content storage
  • Stripe, Inc. — Payment processing
  • Resend — Transactional email delivery
  • Twilio — SMS notifications (pulse check)
  • Google Cloud Vision — Document verification (keyholder)
  • Google Analytics — Anonymized website analytics

10. Acceptable Use

You agree to use the Service only for its intended purpose: the storage and scheduled delivery of personal legacy messages. You shall not use the Service to store or transmit content that is illegal, threatening, defamatory, or that infringes upon the rights of any third party.

Afterword reserves the right to suspend or terminate accounts that violate these Terms, subject to Swiss law.

11. Limitation of Liability

Content Neutrality: We do not see or moderate your messages. You agree to indemnify Afterword against any claims arising from the nature of the data you choose to store.

Service Limitations: To the maximum extent permitted by Swiss law, Afterword's total liability for any claim arising from the use of the Service shall not exceed the amount you paid for your membership. The Service is provided "as is" without warranties of any kind, except those required by applicable law.

12. Modifications to These Terms

We reserve the right to modify these Terms at any time. Any material changes will be communicated via email to your registered address. Continued use of the Service after such notification constitutes acceptance of the updated Terms.

13. Governing Law & Jurisdiction

These Terms are governed exclusively by the laws of Switzerland. Any disputes arising out of or in connection with these Terms shall be resolved exclusively in the courts of Basel-Landschaft, Switzerland.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
